These Terms of Service ("Terms") govern your access to and use of theSnack website, applications, video tools, coaching workflows, and related services (collectively, the "Services") provided by Openfire LLC ("we," "us," or "our").

By accessing or using the Services, you agree to these Terms. If you do not agree, do not access or use the Services.

1. Acceptance of Terms

By creating an account or using the Services, you agree to these Terms and our Privacy Policy, which is incorporated herein by reference.

If you use the Services on behalf of a team, school, company, or other organization, you represent that you have authority to bind that organization to these Terms. In that case, "you" refers to both you and that organization.

2. Eligibility

You must be at least 13 years old, or the applicable minimum age in your jurisdiction, to use the Services. If you are under 18, you may use the Services only with permission from a parent or guardian.

3. Account Registration

Some features require an account. When creating or maintaining an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Use of Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, educational, coaching, or internal business purposes.

You agree not to:

  • Use the Services for any illegal or unauthorized purpose
  • Violate any laws, regulations, or third-party rights
  • Interfere with or disrupt the Services, systems, or networks
  • Attempt to gain unauthorized access to any part of the Services
  • Use automated means to access the Services without our permission
  • Transmit viruses, malware, or other harmful code
  • Impersonate any person or entity
  • Misrepresent your affiliation with a team, school, company, or other organization

5. User Content

The Services may allow you to upload, submit, store, or share videos, text, images, assignments, comments, and other materials ("User Content"). You retain ownership of your User Content. By uploading or sharing User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, distribute, and display that User Content only as needed to provide, secure, support, and improve the Services.

You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not infringe any third-party rights
  • Your User Content complies with these Terms and applicable laws

We may remove User Content that violates these Terms, infringes someone else's rights, creates safety or security risk, or is otherwise unlawful.

6. Intellectual Property

The Services, including their design, software, content, features, and functionality, are owned by Openfire LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. This section does not apply to your User Content.

Nothing in these Terms grants you any right, title, or interest in our intellectual property except for the limited right to use the Services described above. Our trademarks, logos, and service marks may not be used without our prior written consent.

7. Subscription and Payment

Some features require a paid subscription. By subscribing to a paid plan, you agree to pay the fees shown at the time of purchase.

  • Subscriptions automatically renew unless cancelled before the renewal date
  • All paid plans include a 30-day money-back guarantee. If you are not satisfied within 30 days of your initial subscription purchase, you may request a refund by contacting support at support@snack.io. See our Refund Policy for details
  • After the 30-day guarantee period, fees are non-refundable except as required by law
  • We may change our pricing with reasonable notice
  • You are responsible for all taxes associated with your subscription

If payment fails, we may suspend or terminate your access to paid features.

8. SMS and Text Message Communications

Snack may send you SMS text messages to verify your identity when you sign up, log in, or perform security-related actions on your account. By providing your mobile phone number and requesting a verification code, you consent to receive these transactional text messages from Snack.

  • Program: Snack Account Verification
  • Purpose: One-time passcodes for account sign-up, login, and security verification
  • Frequency: Message frequency varies based on your login and verification activity
  • Message and data rates may apply
  • Reply STOP to opt out or HELP for assistance at any time
  • Carriers are not liable for delayed or undelivered messages

You may opt out of SMS messages at any time by replying STOP. After opting out, you will not receive further text messages from Snack unless you re-initiate a verification request. For help, reply HELP or contact us at support@snack.io.

9. Termination

You may terminate your account at any time by contacting us or using the account settings in the Services. We may suspend or terminate your account or access to the Services if you violate these Terms, create risk for other users or the Services, or if we discontinue all or part of the Services.

Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENFIRE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Openfire LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your User Content, or your violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law rules.

Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located inFlorida, United States, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms on our website and update the effective date at the top of this page. Your continued use of the Services after the updated Terms take effect means you accept the changes.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Openfire LLC regarding the Services and supersede all prior agreements and understandings.
